PUBLICATION OF NEW SPANISH LAW 14/2014 OF MARITIME NAVIGATION 

The Law 14/2014 of Maritime Navigation has been published in todays in the Spanish Official Bulletin and will enter into force within two months that is in September 2014.

As you may be aware, the draft of this law has been discussed and under “construction” since 2004.

The aim of this new law is to reform and modernize the Spanish legislation ruling the Maritime Sector – amongst which was the Book III of Spanish Commercial Code of 1885 – adapting it the reality of today’s maritime transport.

Within the 524 articles of the Law 14/2014, we will find the regulation of diverse matters, such as the diverse maritime contracts:

-          Ship agency (and the long discussed matter of their liability),

-          Charter Party,

-          Nautical Leasing,

-          Maritime Insurance.

It also incorporates and deals with other issues such as limitation of liability, pollution, maritime heritage, fishing and seafarers.
